you make some fair points and it’s true to say that hard figures are missing from much of this debate. But do check the Spreeblick article for more on this. Perhaps you misunderstand us as being entirely anti-GEMA? we believe they have the right to defend their members’ interests and we also acknowledge that the PRS/YouTube deal left many unhappy. However, I believe Sacem have somehow reached agreement with YouTube, have they not? But it’s not just YouTube that finds it so difficult to agree workable terms with GEMA, there is a list of companies in a similar position, not all sharing Google’s attitude to content. Yes, GEMA should defend its members but it should also encourage enterprise and international opportunities for German writers AND performers – this isn’t really happening in the current situation. so where do we go?

It’s a vital debate, but no figures are thrown about here. So it’s hard to put this into context. How do the current figures compare with radio or other uses? What is 1 million plays worth on YouTube, for example? Pointing to Gema as the odd-man-out in the PRO world does not help, as there is a very real feeling that the PRS buckled under pressure rather than agreeing to a sustainable rate. It’s worth remembering that this debate is happening against the background of increased pressure on authors rights globally. Should GEMA, Sabam and Sacem give in to pressure of a large industrial group that based its business model on the exploitation of other people’s copyrights? It wouldn’t be the first time that rights holders are being asked to “get with it” (see: Napster and Spotify). The rights were the last thing on people’s minds when these things were developed. Will authors’ rights again be asked to pick up the slack?
